ഓർത്തോഡോക്സ് സഭ സ്വയം ശീർഷക സഭയോ ?"

അടുത്ത കാലത്തായി  ഓർത്തോഡോക്സ്  സഭയെ "  സ്വയം ശീർഷക സഭ  " എന്ന് വ്യാപകമായി  പ്രചരിപ്പിക്കുന്നുണ്ട് .പതിനാറാം നൂറ്റാണ്ടിന് ശേഷം മാത്രമാണ് അന്ത്യോഖ്യാ സിംഹാസനവും മലങ്കര സഭയും തമ്മിലുള്ള ബന്ധത്തിന്റെ തുടക്കം എന്നും അവർ വ്യാപകമായി  പ്രചരിപ്പിക്കുന്നു. ചരിത്രപരമായ യാതൊരു തെളിവും ഇല്ലാത്ത തികച്ചും വസ്തുതാ വിരുദ്ധമായ വ്യാജ പ്രചരണങ്ങളാണ് ഇവയൊക്കെ. ഇനി യഥാർത്ഥ വസ്തുത എന്താണെന്ന് നോക്കാം.

യാക്കോബായ ഓർത്തഡോക്സ് സഭാതർക്കങ്ങളിൽ തീർപ്പു കൽപ്പിച്ചു 1958  , 1995  ,2017  വർഷങ്ങളിൽ  ഇന്ത്യയുടെ പരമോന്നത നീതി പീഠം മൂന്ന് വിധികൾ പുറത്തിറക്കിയിട്ടുണ്ട്  ഈ വിധികൾ എല്ലാം ഇരുവിഭാഗങ്ങളും കോടതിയിൽ സമർപ്പിച്ച തെളിവുകളുടെയും ,റോയൽ കോടതി വിധിമുതലുള്ള മുൻകാല കോടതിവിധികളെയും ആധാരമാക്കി പ്രസിദ്ധീകരിച്ചിട്ടുള്ളതാണ് . ആമുഖത്തിൽ സൂചിപ്പിച്ച  ഓർത്തഡോൿസ് സഭയുടെ രണ്ട് അവകാശ വാദങ്ങളും സുപ്രീം കോടതിയുടെ മുമ്പിൽ തർക്കങ്ങളായി ഉന്നയിക്കുകയും തീർപ്പ് കൽപ്പിച്ചു വിധി പറഞ്ഞിട്ടുള്ളതുമാണ്. സുപ്രീംകോടതി വിധിക്ക് നേർ വിപരീതമാണ് ഈ വ്യാജ ചരിത്ര അവകാശവാദങ്ങൾ.

ഈ തർക്കത്തിൽ തീർപ്പ് കൽപിച്ചു സുപ്രീം കോടതി 1995 ൽ പുറത്തിറക്കിയ വിധിയിൽ "സ്വയം ശീർഷക സഭ"വാദം തള്ളിക്കളഞ്ഞത് ശ്രദ്ധിക്കുക 

The most sensitive issue which has been subject of great debate in this Court was posed as Question No.18,"Has the Malankara Church become an autocephalous church? and it was answered against the respondent by recording the finding:-

 "We, therefore, hold that the Malankara Church is not an autocephalous church but is a part or division of the world Orthodox Syrian Church and set aside the finding of learned single judge that the Catholicos group has now established an autocephalous church We hold that while Patriarch of Antioch is the head of the World Orthodox Syrian church Catholicos of the East who is subject to the Constitution is head of The Malankara Church and the relationship between Patriarchate and the Malankara Church is governed by the provisions of the Constitution."

അന്ത്യോഖ്യാ സിംഹാസന ബന്ധം പതിനാറാം നൂറ്റാണ്ടിന് ശേഷം മാത്രമോ?

ഓർത്തോഡോക്സ് സഭയുടെ മറ്റൊരു കുപ്രചരണം മലങ്കര സഭക്ക് അന്ത്യോഖ്യാ സിംഹാസനവും ആയുള്ള ബന്ധം പതിനാറാം നൂറ്റാണ്ടിനു ശേഷം മാത്രം ആണെന്നതാണ്

ഓർത്തോഡോക്സ് സഭയുടെ ഈ പ്രചാരണവും സുപ്രീം കോടതി വിധിക്ക് എതിരാണ് ' ജസ്റ്റിസ് അരുൺ മിശ്ര തന്നെ ഇതിന് ഉത്തരം നൽകുന്നുണ്ട് 

• 26. In 1995 judgment this Court has given the findings in para 148 and the same are extracted hereunder :

• “148. The following facts, in our considered view, are of fundamental significance. Once they are kept in view, it would be unnecessary to go into many of the issues agitated before the learned Single Judge and the Division Bench of the High Court. The fundamental facts which decide the fate of the main dispute are:

(a) The Patriarch of Antioch was undoubtedly acknowledged and recognised by all the members of the Malankara Church as the supreme head of their Church. In the year 1654, they took the oath known as the “Coonan Cross Oath” reaffirming their loyalty to the Syrian Orthodox Christian Church headed by the Patriarch. It was the Patriarch who convened the Mulanthuruthy Synod at which the Malankara Syrian Christian Association was formed. However, the authority of the Patriarch extended only to spiritual affairs — the Syrian Christians in Malankara believed in the efficacy of ‘Kaiyoppu’ (laying of hands by Patriarch on the head) while consecrating the Metropolitan and considered it essential to a proper ordain — but not to the temporal affairs of the Malankara Church as declared finally by the Travancore Royal Court of Final Appeal in the year 1889 in the Seminary suit.

1654 ൽ മട്ടാഞ്ചേരിയിൽ ഒത്തു കൂടിയ സുറിയാനി സഭാ വിശ്വസികൾ പറങ്കിപ്പടയുടെ വിലക്കുകളെ മറികടന്ന് കൂനൻ കുരിശ് ഏറ്റു പറഞ്ഞ വിശ്വാസ പ്രതിജ്‌ഞ ശൂന്യാകാശത്ത് നിന്ന് ലഭിച്ച വിശ്വാസ ധാരണയല്ല. നൂറ്റാണ്ടുകളായി തലമുറകളിലൂടെ പകർന്നു കിട്ടിയ രക്തത്തിൽ അലിഞ്ഞു ചേർന്ന വിശ്വാസ പുനപ്രഖ്യാപനം ആയിരുന്നു അത്. ചരിത്ര പ്രധാനമായ ആ ഒത്തുചേരലിന് പ്രേരകമായ പ്രകോപന കാരണം വിദേശത്തു നിന്ന് എത്തിയ ഒരു മഹാപുരോഹിതനെ കടലിൽ കെട്ടി താഴ്ത്തി കൊന്നു എന്ന വാർത്ത ആയിരുന്നു , ഈ ചരിത്രത്തെ വക്രീകരിച്ചു കൂനൻ കുരിശ് സത്യം വൈദേശിക മേധാവിത്തത്തിന് എതിരായ സ്വാതന്ത്ര്യ പ്രഖ്യാപനമായി വ്യാഖ്യാനിക്കുന്നത് ചരിത്രത്തോട് കാണിക്കുന്ന അനീതിയാണ് . റോയൽ കോടതിയുടെ മുന്നിൽ പാലക്കുന്നത്ത് മാത്യൂസ് മോർ അത്താനാസിയോസ് ഉന്നയിച്ചതും ചരിത്ര തെളിവുകൾ നിരത്തി റോയൽ കോടതി തള്ളി കളഞ്ഞതുമായ അതേ കാര്യങ്ങളാണ് പ്രചരിപ്പിച്ച് സ്വതന്ത്ര സഭാ സ്ഥാപനത്തിന് ആശയാടിത്തറ സൃഷ്ടിക്കാൻ ശ്രമിക്കുന്നത്.  

സഭാ തർക്കം സംബന്ധിച്ച സുപ്രീം വിധി അണുവിട ലംഘിക്കാതെ നടപ്പിലാക്കാൻ ശാഠ്യം പിടിക്കുന്ന അതേ ഓർത്തോഡോക്സ് സഭ തന്നെയാണ്  സുപ്രീംകോടതി തീർപ്പാക്കിയ തർക്ക പ്രശ്നങ്ങൾ സംബന്ധിച്ച സുപ്രീംകോടതി വിധിക്ക് വിരുദ്ധമായ വ്യാജ ചരിത്ര രചനയുമായി രംഗത്തിറങ്ങിയിരിക്കുന്നത് ഇത് തികച്ചും വിചിത്രകരമായ നിലപാട് തന്നെ.
